Data Collected Behind The Scenes

A disturbing trend has been commented upon by United States Congressional representatives. A number of websites have been collecting information of individuals who have visited their sites, and the United States representatives want to know the exact amount of personal data that has been collected as well as the intentions of the websites and what they are going to do with the information they collected. The two representatives, one a Republican and the other a Democrat, had letters delivered to as many as 15 websites, including Comcast, Microsoft, and the Yahoo website. Joe Barton and Ed Markey, who are senior members belonging to the House Energy and Commerce Committee, stated in the delivered documentation they have very high concerns related to the practices of information privacy.

“From the report we have received we are greatly disturbed that consumers who utilize the Internet is constantly losing the privacy of their personal data, particular preferences, and extremely intimate information to the various information monitoring organizations, various websites, and data marketers who are in the practice of collecting personal information for the sole purpose of creating online records for a variety of intentions. Congress is in the initial stages of preparing very encompassing legislation related to privacy issues, and we desire your response to our inquiries in order to understand the practices of your organization.” The Committee is in the early stages of motions to create website rules of privacy. Leaders of the Committee will attempt to create this legislation of privacy later in the year.

The delivered documentation requests the types and kind of personal information being collected, any partners of a third-party nature, and what the various websites are doing with the collected information. It has also been requested if the site organizations sell the information or use it for financial reasons. With seven days to answer the letter, the lawmakers also want to know the amount of money that has garnered from the sale for any other use of the personal information. While some of the websites have yet to respond to the letter, Microsoft, through a spokesperson has indicated Microsoft is very serious about being responsible in the protection and privacy of user's information concerning their software products. An advocate of privacy for the Center for Digital Democracy stated the general public and our lawmakers must have a greater understanding of how data is being collected online. “Our United States representatives have a track record of pushing forth issues of privacy. The information they accumulate will provide us with a better idea of the practice of data harvesting behind the scenes without a user's consent.”

The House Energy and Commerce Committee recently conducted proceedings concerning the Best Practices Act, which would eventually require web locations to accept permission for users to opt in first, before any data sharing of their personal information with partners commences. This act will also give permission of lawsuits against organizations in violation of the privacy act and give enforcement capabilities to the United States Federal Trade Commission as well as attorney generals of a particular state.
